ORDINANCE 01-2023

AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF CENTURY, FLORIDA, SETTING THE DATE, TIME AND PLACE OF A SPECIAL NONPARTISAN ELECTION FOR THE PURPOSE OF ELECTING A COUNCIL MEMBER TO COUNCIL SEAT NO. 3 AND TO COUNCIL SEAT NO. 4; SETTING THE QUALIFYING DATES, TIMES AND PLACES; ESTABLISHING QUALIFICATIONS OF CANDIDATES AND QUALIFYING FEES;  ESTABLISHING VOTER REGISTRATION DATES; ESTABLISHING AN EFFECTIVE DATE; AND TRANSMITTAL OF THIS ORDINANCE TO THE ESCAMBIA COUNTY SUPERVISOR OF ELECTIONS.

WHEREAS, on the first Monday of January 2023, Council Seat Number 3 and Council Seat Number 4 were vacant due to the fact that no electors qualified to run for election to those seats for the 2022 November Election; and

WHEREAS, Town Charter Section 5.05(c) Filling of Vacancies dictates a special Town election is to be held not sooner than sixty (60) days, nor more than ninety (90) days following the occurrence of the vacancy; and

WHEREAS, Town Charter Section 5.05(c) Filling of Vacancies additionally requires that if a special primary election is necessary, it shall be scheduled two (2) weeks prior to the special election.

NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL:

SECTION 1:  Hold Special Election:  The Town shall hold a special election for Council Seat Number 3 and Council Seat Number 4.

SECTION 2:  Election Dates, Times and Place: 

  • Primary Election: On Tuesday, March 14, 2023 from 7:00 a.m. to 7:00 p.m. a PRIMARY ELECTION shall be held at Century Town Hall, 7995 North Century Blvd., Century, Florida, for contests with three (3) or more candidates. 
  • Runoff ElectionThe RUNOFF ELECTION, if necessary, shall be held on Tuesday, March 28, 2023, at Century Town Hall, 7995 North Century Blvd., Century, Florida, from 7:00 a.m. to 7:00 p.m. simultaneous with the General Election.
  • General Election:  The GENERAL ELECTION contests where there are only two (2) candidates shall be held on Tuesday, March 28, 2023, at Century Town Hall, 7995 North Century Blvd., Century, Florida from 7:00 a.m. to 7:00 p.m. simultaneous with the Runoff Election.

SECTION 3:  Purpose:  The purpose of the election is to elect members to the following vacant Council Seats:

  • Council Seat Number 3
  • Council Seat Number 4

SECTION 4: Qualifying Dates, Times and Place:  Qualifying shall be held from noon on Tuesday, February 21, 2023 and will end at 12:00 noon on Friday, February 24, 2023.  Any registered voter living in the Town of Century may qualify at the Supervisor of Elections Office at 213 Palafox Place, 2nd Floor, Pensacola, Florida 32502, from noon that Tuesday through noon that Friday during office hours and at Town Hall on Wednesday, February 22, 2023 between 9:00 a.m. and 3:00 p.m.

SECTION 5:  Qualification of Candidates:  To qualify for the Office of Town Council, a candidate must be a registered voter in the Town of Century per SECTION 3.02 of the Town of Century Charter, and must pay a qualifying fee. 

SECTION 6:  Qualifying Fees:  The qualifying fee shall be comprised of an Election Assessment based on 1% of the annual salary as required in Florida Statute 99.092(1), equal to $37.15 plus a $12.85 filing fee required by Century Town Council for a total qualifying fee of $50.00.

SECTION 7:  Voter Registration:  For the March 14, 2023 Primary Election, voter registration books will close on Monday, February 14, 2023; and, for the March 28, 2023 General Election, voter registration books will close on Monday, February 27, 2023.

SECTION 8:  Effective Date:  This ordinance shall become effective immediately after its passage.

SECTION 9: Transmittal to Supervisor of Elections:  The Town Clerk is directed to immediately provide a copy of this executed Ordinance to the Supervisor of Elections’ office.

PASSED AND ADOPTED THIS ___ DAY OF FEBRUARY, 2023, by the Town Council of the Town of Century, Florida.

First reading approved on the 17th day of January, 2023.

Advertised on the 26th day of January, 2023.
